Terms of Service

The short version
SmokeViz is a picture, not an engineering analysis. The solver is deliberately qualitative — it shows how air might move around a shape so you can build intuition. It must never be used for real aerodynamic, structural, or safety decisions. If a decision matters, use validated CFD or physical testing.
Your models stay yours — and stay on your machine. Everything runs locally in your browser; we never receive your files and claim no rights over them. You're responsible for having the right to use whatever you load.
It's free, provided as-is, and needs WebGPU. We make no promise it will run on your hardware, be accurate, or be available. Our liability is strictly limited, and disputes go to individual arbitration.
That's the plain-English gist. The full terms below are what's binding.
1.Acceptance of these Terms
These Terms of Service ("Terms") are a legal agreement between you and TheDigicar LLC ("SmokeViz," "we," "us," or "our") governing your access to and use of the SmokeViz website and web application at smokeviz.com, and any related features, content, and services (collectively, the "Service").
BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.
THESE TERMS INCLUDE AN IMPORTANT DISCLAIMER THAT THE SERVICE IS NOT ENGINEERING ADVICE (SECTION 3) AND REQUIRE BINDING INDIVIDUAL ARBITRATION OF DISPUTES AND WAIVER OF CLASS ACTIONS (SECTION 17). PLEASE READ THEM CAREFULLY.
You represent that you are at least eighteen (18) years of age (or the age of majority in your jurisdiction, whichever is greater), that you are legally able to enter into a binding contract, and that you are not barred from using the Service under any applicable law. There is no account to create; using the Service constitutes acceptance.
2.What SmokeViz is (and is not)
SmokeViz is a free, browser-based aerodynamic flow visualiser. You load a 3D model in your browser, and the Service renders an interactive, qualitative picture of simulated airflow around it — smoke ribbons, separation, wake behaviour — along with contextual readouts such as an indicative Reynolds number. All processing happens locally on your own device.
SmokeViz is not:
- A computational fluid dynamics (CFD) tool. The real-time solver is deliberately simplified for interactivity. It does not resolve boundary layers, is not validated against experiment, and produces no drag coefficients, forces, pressures, or other quantitative engineering results.
- An engineering, design-validation, or certification service. See Section 3.
- A file-hosting or collaboration service. Your models are never uploaded, stored, or shared; nothing persists between visits.
3.Not engineering advice
THE SERVICE PRODUCES A QUALITATIVE VISUAL APPROXIMATION OF FLUID FLOW, FOR ILLUSTRATION, EDUCATION, AND EXPLORATION ONLY. IT IS NOT ENGINEERING ANALYSIS, IS NOT PROFESSIONAL ADVICE, AND IS NOT A SUBSTITUTE FOR VALIDATED COMPUTATIONAL FLUID DYNAMICS, WIND-TUNNEL TESTING, OR THE JUDGMENT OF A QUALIFIED ENGINEER.
YOU MUST NOT RELY ON THE SERVICE, OR ANYTHING IT DISPLAYS, FOR ANY AERODYNAMIC, STRUCTURAL, SAFETY, REGULATORY, DESIGN-VALIDATION, OR OTHER DECISION WHERE ACCURACY MATTERS — INCLUDING ANY DECISION AFFECTING A VEHICLE, AIRCRAFT, BUILDING, COMPONENT, OR PERSON.
What the visualisation shows may differ substantially — even directionally — from real airflow. Apparent separation points, wake shapes, streamline behaviour, and any displayed numbers (including the Reynolds number readout, which depends on the real-world size you tell the Service the model is) are indicative only. Any decision you take in reliance on the Service's output is entirely your own responsibility.
4.Your models & your content
You retain all right, title, and interest in the 3D models and other files you load into the Service. Because processing is entirely client-side, we never receive, store, host, or transmit your files, and we claim no license or rights over them of any kind.
You are solely responsible for the files you load, including having all rights necessary to use them and ensuring they do not violate any law or third party's rights. Loading a file into your own browser session does not transmit it to us, so there is nothing for us to moderate, take down, or return.
5.License to use the Service; our IP
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service in your browser for its intended purpose. Any other use — including commercial resale, redistribution, or offering the Service's functionality to others as your own — requires our prior written consent.
Except for your models (Section 4), the Service and all of its software, design, content, compilation, and other materials are owned by TheDigicar LLC or its licensors and are protected by intellectual-property laws. "SmokeViz" and the SmokeViz mark are marks of TheDigicar LLC. All rights not expressly granted are reserved. You may not copy, modify, create derivative works from, reverse engineer, scrape, frame, or redistribute the Service or any part of it except as expressly permitted by these Terms or applicable law.
6.Acceptable use
In connection with the Service, you will not:
- Violate any applicable law, including export-control laws;
- Interfere with or disrupt the Service or its infrastructure — including the analytics endpoint — or impose unreasonable load on it;
- Probe, scan, or test the vulnerability of the Service or breach its security, other than good-faith responsible disclosure reported to thedigicar@gmail.com;
- Scrape, mirror, or rehost the Service, or misrepresent its origin or your affiliation with us;
- Upload viruses or malicious code, or attempt to gain unauthorized access to systems or data.
7.Privacy
Our Privacy Policy describes the little we handle — no accounts, no cookies, no stored models, an anonymous first-party visit counter, and standard transient hosting logs — and forms part of these Terms by reference.
8.Free service; changes to the Service
The Service is currently provided free of charge; no payments are processed and no refund terms apply. We may modify, suspend, or discontinue the Service or any part of it at any time, with or without notice, and we will not be liable to you or any third party for doing so. If we ever introduce paid features, these Terms will be updated first.
9.Availability & hardware requirements
The Service requires a WebGPU-capable browser and a compatible GPU. We make no promise that it will run on your hardware, run well, or run at all. The Service is provided on an "as available" basis; simulation behaviour, fidelity, and hardware requirements may change between versions without notice.
10.Feedback
If you send us suggestions, ideas, or other feedback about the Service, we may use it freely, in any form and for any purpose, without restriction, credit, or compensation to you.
11.Changes to these Terms
We may update these Terms from time to time. The current version will always be posted at this page with its effective date; for material changes we will provide notice by reasonable means, such as a notice within the Service. Your continued use of the Service after updated Terms take effect constitutes acceptance. If you do not agree to the updated Terms, stop using the Service.
12.Termination
You may stop using the Service at any time; because nothing is stored, there is nothing to delete. We may suspend, restrict, or terminate access to the Service (for example, by blocking abusive traffic) at any time, with or without notice, if we believe these Terms have been violated or if we reasonably deem it necessary to protect the Service or its users. Sections that by their nature should survive — including Sections 3, 4, 5, 10, and 13 through 18 — survive termination.
13.Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT AND OUTPUT WITHIN IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. THEDIGICAR LLC EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; THAT THE VISUALISATIONS OR ANY DISPLAYED VALUES ARE ACCURATE, REALISTIC, OR COMPLETE; THAT THE SERVICE IS COMPATIBLE WITH YOUR HARDWARE; OR THAT ANY DEFECT WILL BE CORRECTED.
14.Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEDIGICAR LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND LICENSORS (THE "SMOKEVIZ PARTIES") SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR ANY LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE — INCLUDING ANY DECISION MADE IN RELIANCE ON ITS OUTPUT — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL THE SMOKEVIZ PARTIES' TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF FIFTY U.S. DOLLARS ($50) OR THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE.
The limitations in this section do not apply to liability that cannot be limited under applicable law, including liability arising from our gross negligence or willful misconduct. Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you; consumers in the EEA and UK retain all mandatory statutory rights.
15.Indemnification
You will indemnify, defend, and hold harmless the SmokeViz Parties from and against any claims, demands, losses, damages, costs, liabilities, and expenses (including reasonable attorneys' fees) arising from or relating to: (a) your access to or use of the Service; (b) the models and other files you load and your rights (or lack of rights) in them; (c) your violation of these Terms or any law; (d) your violation of any third party's rights; or (e) any decision made, product built, or action taken in reliance on the Service's output.
16.Governing law
These Terms are governed by the United States Federal Arbitration Act, applicable federal law, and the laws of the State of Florida, without regard to conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
17.Arbitration & class action waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR CLAIMS.
(a) Agreement to arbitrate. You and TheDigicar LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or your access to or use of the Service (each, a "Claim") shall be resolved by binding arbitration on an individual basis, rather than in court — except that (i) either party may bring an individual claim in small claims court if it qualifies, and (ii) either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual-property rights.
(b) Procedure. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, available at adr.org, before a single neutral arbitrator, conducted in English. Payment of filing, administration, and arbitrator fees will be governed by the AAA's rules. Arbitration may be conducted by videoconference or, if in person, in the county where you reside (or another mutually agreed location). The arbitrator's decision is final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
(c) Class action waiver. ALL CLAIMS MUST BE BROUGHT IN THE PARTIES' INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN ARBITRATION, EACH PARTY WAIVES ANY RIGHT TO A JURY TRIAL, AND SUCH CLAIM SHALL BE BROUGHT EXCLUSIVELY IN THE STATE OR FEDERAL COURTS LOCATED IN ORANGE COUNTY, FLORIDA, AND YOU CONSENT TO THEIR JURISDICTION AND VENUE.
(d) Opt-out. You may opt out of this arbitration agreement by emailing thedigicar@gmail.com within thirty (30) days of first accepting these Terms, with the subject line "Arbitration Opt-Out" and your name. Opting out of arbitration does not affect any other part of these Terms.
(e) Severability. If the class action waiver is found unenforceable as to a particular Claim, then the arbitration agreement shall not apply to that Claim, which shall proceed in the courts identified in subsection (c); all other Claims remain subject to arbitration.
18.General provisions
These Terms, together with our Privacy Policy, constitute the entire agreement between you and TheDigicar LLC regarding the Service, and supersede all prior agreements on that subject. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, sale of assets, or by operation of law. Our failure to enforce any provision is not a waiver. If any provision is held invalid or unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force. We are not liable for any failure or delay caused by events beyond our reasonable control. There are no third-party beneficiaries to these Terms except the SmokeViz Parties as expressly provided.
